Physician-patient privilege
Declaration of consent regarding the collection and processing of health data and declaration of waiver of physician-patient privilege
During the processing of your application, contract or claim, it might become necessary to exchange information with third parties. The German Insurance Contract Act (VVG), the General Data Protection Regulation (EU GDPR), the new Federal Data Protection Act (BDSG) as well as other data protection legislation so far failed to provide a sufficient legal basis for the collection, processing and use of health data by insurance companies. However, in order to be allowed to collect and use health data for your application and contract, the DR-WALTER GmbH (hereinafter referred to as DR-WALTER) needs your consent as well as your declaration of waiver of physician-patient privilege to collect your health data from persons or institutions that provide physician-patient privilege (e. g. physicians). DR-WALTER also needs your declaration of waiver of physician-patient privilege to be able to forward your health data or other data protected under § 203 StGB (German Criminal Code), e. g. the fact that a contract exists between you and DR-WALTER, to other bodies such as assistance providers, IT providers, etc.
